Rule 37
Community forest withdrawal

(1) If information is received that the user group has not been able to conduct the work according to the action plan or has done any work that has a significant adverse effect on the environment or has not followed the conditions set by the Act or this regulation and the Government of Nepal, the District Forest Officer shall dispatch staff as soon as possible and conduct an on-site inspection based on the report. Action should be taken as follows:-
(a) If it appears from the report that the consumer group has not been able to carry out the work according to the action plan or has done any work that has a significant adverse effect on the environment or has not followed the conditions set by the Act or this regulation and the Government of Nepal, the consumer group should be given a deadline of fifteen days and demand an explanation.
(b) If the explanation submitted by the consumer group is not satisfactory or if it is deemed appropriate to withdraw the community forest from the on-site report, the District Forest Officer may withdraw the said forest and cancel the registration of the said consumer group.
(c) Information about withdrawal of community forest and cancellation of registration of consumer group should be given to the concerned consumer group within fifteen days from the date of such cancellation.
(2) According to sub-rule (1), the consumer group who is not satisfied with the decision to withdraw the community forest and cancel the registration may file a complaint with the relevant director within thirty five days of receiving the notification of such decision.
(3) The decision on the complaint under sub-rule (2) should be decided within ninety days from the date of filing the complaint.
